This page explains the terms that apply when you visit eventheadshots.com (the “Site”) or contact us about event headshots, and how we handle the information you share with us. Event Headshots is a service line of BLINK Photo Co.

Part 1 · Booking Terms

Booking Terms (Estimates and Contracts)

These terms apply to estimates, invoices and bookings from Idea Beach LLC, d/b/a BLINK Photo Co. (Event Headshots by BLINK).

1.Agreement and acceptance

These Booking Terms form a legally binding contract between Idea Beach LLC, d/b/a BLINK Photo Co. (“BLINK”, “we”) and the client named on the estimate. They apply to every estimate, invoice and booking we issue and are incorporated into each estimate by reference. Accepting an estimate, paying the retainer or confirming a booking in writing means you accept these terms.

2.Scope of services

The services are the ones described on the estimate (for example event headshot stations, team headshots or event coverage), on the dates, at the location and for the hours stated. Anything outside that scope requires a written change to the estimate.

3.Booking, retainer and date reservation

A retainer of 50% of the estimate total is due at booking. The retainer reserves your date exclusively for you: once it is paid, we hold the date and decline other work for it. For that reason the retainer is earned when received and is non-refundable. It is applied to your final invoice. There are no refunds. If you cancel with 15 or more days’ notice, everything you have paid is held as a credit toward a BLINK booking within 12 months of the original event date, at the rates in effect for the new date. A credit is non-transferable and cannot be redeemed for cash. Rescheduling is subject to our availability.

4.Payment terms

The 50% retainer described in section 3 is due upon booking. The balance is due no later than the end time of the event. No images or deliverables are released until payment is received in full. A flat $300 late fee applies to balances paid after the due date. We accept ACH, credit card, check and Zelle.

5.Cancellation and rescheduling

Cancellations must be made in writing to studio@blinkphoto.co. There are no refunds. If you cancel with 15 or more days’ notice, no further balance is due, and everything you have paid is held as a credit as described in section 3. If you cancel with fewer than 15 days’ notice, 100% of the project amount is due and is not credited, because the date can no longer reasonably be rebooked. You may reschedule once without penalty with 15 or more days’ notice, subject to availability; the new date must fall within 12 months of the original event date.

6.Image delivery and turnaround

Delivery timing is stated on the estimate. Where the estimate includes real-time delivery (for example slightly retouched headshots delivered through individual galleries during the event), those images are delivered as described on the estimate. Otherwise, headshot sessions are delivered within 5 to 10 business days and full event coverage within 10 to 20 business days, unless a rush is agreed in writing. No images are delivered before full payment.

7.Image usage rights and license

BLINK retains the copyright and all intellectual property in the images. After full payment, the client receives a non-exclusive, perpetual license to use the images for internal and external business purposes, including websites, presentations, print and social media. The images may not be resold or sublicensed without our written consent, and may not be altered in a way that is misleading. BLINK may use the images in its portfolio and marketing unless the client makes a written confidentiality request before the event. The client is responsible for obtaining any required model releases.

8.Limitation of liability

Our total liability is limited to the amount the client has paid under the estimate. If we cannot attend because of illness or emergency, we will make reasonable efforts to find a substitute photographer; if we cannot, we will refund all payments made.

9.Force majeure

If events outside either party’s reasonable control (such as severe weather, natural disaster, government action or venue closure) prevent the event from taking place, we will reschedule in good faith at no additional cost.

10.On-site conditions

The client provides a safe environment, adequate space, lighting, power and internet access where needed. We are not responsible for missed coverage caused by restricted access, schedule changes or uncooperative subjects.

11.Governing law and disputes

These Booking Terms are governed by the laws of the State of Florida. Disputes will be resolved by binding arbitration administered by the American Arbitration Association in Miami-Dade County, Florida. The prevailing party recovers reasonable legal fees.

12.Entire agreement

The estimate and these Booking Terms are the entire agreement between the parties. Amendments must be in writing. Electronic acceptance, including payment of the retainer, constitutes agreement.

Part 2 · Terms of Use

Terms of Use

1.Acceptance of these terms

By using eventheadshots.com you agree to these Terms of Use. If you do not agree with any part of these terms, please do not use the Site. Your continued use of the Site, or submission of an inquiry through our forms, confirms your acceptance.

2.About this website

eventheadshots.com is operated by Idea Beach LLC, d/b/a BLINK Photo Co. (“BLINK,” “we,” “us,” or “our”). The Site provides information about our event headshot services and allows potential clients to request a quote or learn about our process. The Site is provided for informational and sales inquiry purposes.

3.Use of the site

You agree to use the Site only for lawful purposes and in a way that does not infringe on the rights of others. You agree not to:

• Attempt to gain unauthorized access to any part of the Site or its systems
• Interfere with or disrupt the Site, its servers, or its networks
• Use the Site to transmit viruses, malicious code, or other harmful content
• Scrape, copy, or systematically extract content from the Site for commercial purposes without written permission
• Impersonate BLINK or any other person or entity when communicating through the Site

4.Inquiries and communications

When you submit an inquiry through a form on the Site, or contact us by email or phone, you are initiating a business communication with us. We may respond to your inquiry by email, phone, or text using the contact information you provide. Submitting an inquiry does not create a contract for services. Any engagement for services is established only through an estimate from us that you accept in writing or by paying the retainer. Each estimate incorporates the Booking Terms above.

5.Intellectual property

All content on the Site, including text, graphics, photographs, logos, and design elements, is owned by BLINK Photo Co. or used with permission of the applicable rights holder. Client logos displayed on the Site are the property of their respective owners and are used for identification purposes only.

Except as needed for you to view and evaluate our services in a browser, no content on the Site may be copied, reproduced, distributed, or used for any commercial purpose without our prior written consent.

6.Third-party links

The Site may contain links to third-party websites or resources, such as our parent company page at blinkphoto.co, social media profiles, and our form provider. We are not responsible for the content, privacy practices, or business practices of those third parties. Use of any third-party website is at your own risk and subject to that site's own terms and policies.

7.Disclaimer of warranties

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, BLINK disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be available without interruption, error-free, or free of viruses or other harmful components. Pricing, package details, and other information on the Site are provided for general reference; the actual terms applicable to any event are those set out in a written proposal or agreement between you and BLINK.

8.Limitation of liability

To the fullest extent permitted by law, BLINK Photo Co. and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including loss of data, loss of business, or loss of profits, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

9.Indemnification

You agree to indemnify and hold harmless BLINK Photo Co., its affiliates, and their respective owners, employees, and contractors from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site or your violation of these Terms.

10.Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

11.Changes to these terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes may be noted more prominently on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.

Part 3 · Privacy Policy

Privacy Policy

1.Overview

This Privacy Policy explains what information BLINK Photo Co. collects when you visit eventheadshots.com or contact us about event headshots, how we use it, and the choices you have. We take your privacy seriously and only collect information that is necessary to respond to your inquiry and operate our business.

2.Information we collect

We collect information you voluntarily provide, and a limited set of technical information that is typical of a website. Specifically:

• Information you submit through our forms: your name, work email address, company or organization, phone number, event date, event location, estimated attendee count, services of interest, and any notes you choose to share with us.
• Information you send by email or phone: the content of your message and any contact information included in it.
• Technical information: basic server log information that your browser typically sends when visiting any website (such as IP address, browser type, and pages visited). This is used for security and performance purposes, not for individual tracking.

We do not knowingly collect Social Security numbers, government IDs, payment card numbers, or other sensitive personal information through this Site. Please do not submit any such information through the forms on this Site.

3.How we use your information

We use the information you share with us to:

• Respond to your inquiry and send you a flat-rate quote or proposal
• Communicate with you by email, phone, or text about your event
• Schedule consultations and finalize logistics if you engage us
• Send follow-up messages related to your inquiry
• Maintain internal records for accounting, legal, and operational purposes

We do not use your contact information for unrelated third-party marketing, and we do not sell your personal information.

• Service providers: we use third-party services to operate the Site, including a form delivery service (Formspree) that routes form submissions to our studio inbox, email and calendar providers, and our web hosting provider. These providers process information on our behalf under their own security and privacy terms.
• Legal requirements: we may disclose information if required by law, subpoena, court order, or other legal process, or if we believe disclosure is necessary to protect the rights, property, or safety of BLINK, our clients, or others.
• Business transfers: if BLINK Photo Co. is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, subject to standard confidentiality protections.

We do not sell, rent, or trade your personal information to third parties for their own marketing.

5.Cookies and analytics

eventheadshots.com uses Google tags and Google Ads measurement to understand how visitors find and use the Site and to measure the performance of our advertising. These tools may set cookies or similar identifiers in your browser. When you submit an inquiry form, we also record the page you were on, how you arrived (such as referrer, UTM parameters and Google Click ID), so we can tell which marketing led to your inquiry; this information is kept in your browser session until you submit the form. Your browser settings let you clear or block cookies at any time, and you can opt out of Google personalized advertising at adssettings.google.com.

6.Data retention

We retain the information you share with us for as long as needed to respond to your inquiry, deliver services if you engage us, and meet our legal, tax, and accounting obligations. If you have not booked a service and ask us to delete your inquiry record, we will do so promptly, except where we are required to keep it for legal or compliance reasons.

7.Data security

We use reasonable administrative, technical, and physical safeguards to protect the information you share with us. These include access controls on our systems, encrypted transmission of form submissions (TLS/HTTPS), and limiting access to your information to the BLINK staff who need it to respond to you or deliver services.

No method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security, but we will notify you if we become aware of a breach that materially affects the information you provided to us, as required by applicable law.

8.Your rights

Depending on where you live, you may have rights regarding the personal information we hold about you. These may include:

• The right to request a copy of the information we have about you
• The right to request correction of inaccurate information
• The right to request deletion of information we no longer need
• The right to opt out of certain communications

9.Children's privacy

eventheadshots.com is intended for adult corporate buyers, event planners, and marketing teams. It is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child has submitted information through the Site, please contact us and we will delete it.
